Any Party may modify the person and address to whom the notice is to be sent by <br />informing each other Party in writing by certified mail. Nothing in the Stipulation and Judgment <br />shall be interpreted or applied to relieve Defendants of their existing obligations to provide <br />documentation to a federal or state agency, county, city, district, or CUPA as required by statute, <br />regulation, ordinance, permit, or other requirement. <br />NO WAIVER OF RIGHT TO ENFORCE <br />31. The failure of the State Water Board to enforce any provision of the Stipulation and <br />Judgment may not be deemed a waiver of such provision, or in any way affect the validity of the <br />Stipulation and Judgment. The failure of the State Water Board to enforce any such provision <br />shall not preclude the State Water Board from later enforcing the same or any other provision of <br />the Stipulation and Judgment. No oral advice, guidance, suggestion, or comment by employees <br />or officials of any Party regarding matters covered in the Stipulation and Judgment shall be <br />construed to relieve any Party of its obligations under the Stipulation and Judgment. <br />INDEMNIFICATION <br />32. Defendants shall indemnify and save and hold harmless the State Water Board, the <br />State of California, and any of their employees, including each and every constituent agency, <br />board, department, office, commission, fund, or other entity thereof, and successors and assigns <br />of each and every constituent of the State of California (Indemnified Parties), for or from any and <br />all claims or causes of action, of every kind and nature whatsoever, in law and in equity, whether <br />17 <br />Final Consent Judgment (Case No. 34-2014-00164107) <br />
