1 assigns of each and every constituent of the State of California, for any and all claims or causes of <br />2 action, of every kind and nature whatsoever, in law and in equity, whether known or unknown, <br />3 suspected or unsuspected, foreseen or unforeseen, which arise out of or are related to this lawsuit <br />4 or the administrative or investigative actions that preceded it. <br />5 INTERPRETATION <br />6 36. The Stipulation and Judgment were drafted equally by all Parties. The Parties agree <br />7 that the rule of construction holding that ambiguity is construed against the drafting Party shall <br />8 not apply to the interpretation of the Stipulation and Judgment. The Stipulation and Judgment <br />9 shall be governed by and construed in accordance with the laws of the State of California. <br />10 INTEGRATION <br />11 37. The Stipulation and Judgment contains all of the terms and conditions agreed upon by <br />12 the Parties relating to the matters covered by the Stipulation and Judgment, and supersede any <br />13 and all prior and contemporaneous agreements, negotiations, correspondence, understandings, <br />14 and communications of the parties, whether oral or written, respecting the matters covered by the <br />15 Stipulation and Judgment. <br />16 MODIFICATION <br />17 38. The Judgment may be amended or modified only by a writing signed by the parties or <br />18 their authorized representatives, and then by order of the Court. <br />19 KNOWING AND VOLUNTARY STIPULATION AND JUDGMENT <br />20 39. Each Party to the Stipulation and Judgment acknowledged that the Party has reviewed <br />21 all of the terms and conditions of the Stipulation and Judgment, and has agreed to the Stipulation <br />22 and Judgment knowingly and voluntarily. <br />23 AUTHORITY TO ENTER STIPULATION AND JUDGMENT <br />24 40. Each signatory to the Stipulation certified that he or she is fully authorized by the <br />25 Party he or she represents to enter into the Stipulation, to execute it on behalf of the Party <br />26 represented, and to legally bind that Party to the terms and conditions of the Stipulation and <br />27 Judgment. <br />28 <br />19 <br />Final Consent Judgment (Case No. 34-2014-00164107) <br />
