1 Amended Complaint in this action nor this Stipulation and Judgment, shall constitute notice or <br />2 discovery by any governmental entity of any suspected or actual environmental harm, including, <br />3 but not limited to, a release, spill, leak, emission, escape, leach, disposal, or discharge at or from <br />4 any of the Covered Facilities, for purposes of the statute of limitations of claims. <br />5 INJUNCTION <br />6 I. GENERAL INJUNCTIVE PROVISIONS <br />7 8. Pursuant to California Health and Safety Code sections 25299.01 and 25299.04, as of <br />8 the date of entry of the Judgment by this Court: <br />9 (a) Defendants are each enjoined from failing or refusing to comply with the provisions of <br />10 California Health and Safety Code, division 20, chapter 6.7, and California Code of Regulations, <br />11 title 23, section 2610 et seq. (UST Laws), as existing on the date of entry of the Judgment by this <br />12 Court, and as amended in the future, relating to the installation, operation, maintenance, <br />13 modification, repair, or closure of underground storage tanks (USTs) or underground storage tank <br />14 systems at the Covered Facilities or newly acquired UST facilities, and all relevant State, county, <br />15 city, district, and CUPA regulations, ordinances, permits, and orders based on those statutes and <br />16 regulations. <br />17 (b) Defendants are each required to comply with the provisions of California Health and <br />18 Safety Code, division 20, chapter 6.7, and California Code of Regulations, title 23, section 2610 <br />19 et seq., cited as violations at the Covered Facilities on Exhibit B. <br />20 (c) Defendants are each required to comply with the provisions of Health and Safety Code <br />21 sections 25290.1, subdivision (h), 25290.2, subdivision (g), 25291, subdivision (f), and 25292, <br />22 subdivision (e)(1), and Title 23, California Code of Regulations, sections 2636, subdivisions (f)(2) <br />23 and 2643(c)(1) (install and/or maintain automatic line leak detectors on underground pressurized <br />24 piping that conveys a hazardous substance). <br />25 (d) Defendants are each required to comply with the provision of Title 23, California Code <br />26 of Regulations, section 2638 (test and certify UST monitoring equipment). <br />27 <br />28 <br />5 <br />Stipulation for Entry of Final Consent Judgment (Case No. 34-2014-00164107 ) <br />
