SUMMARY OF VIOLATIONS CLASS I, CLASS 11, or MINOR -Notice to Comply) Hazardous Waste Compliance Inspection Class II/ Repeat Violation: 605,135 605. Failed to completely label containers of hazardous waste. A 30 gallon black metal drum, one-third full of used fuel filters, was marked "Empty". All hazardous waste containers shall be marked with the following information: 1. the words "Hazardous Waste", 2. name and address of generator, 3. hazardous properties 4. physical state, 5. composition (contents), 6. accumulation start date Immediately label these containers and ensure that all hazardous waste containers are marked with all the required information. Submit a photographic evidence that this was completed. 135. Failed to submit a written response within 30 days of receiving an inspection report. An Underground Storage Tank and Hazardous Waste official inspection report documented on 06/20/12 was provided to the Store Manager which a faxed copy was sent to Operations Manager. Neither a written response nor a "Return to Compliance" was received by EHD within the due date by 07/30/12. A Return to Compliance follow up letter for non -submittal for UST and HW was issued and mailed on 08/27/12. The certified mail was accepted and signed by the corporate office on 08/29/12. A written response for violations in 2012 year has been yet to be received by EHD. Submit to SJC EHD within 30 days (10/11/13): 1. one copy of the "Return to Compliance Certification" form for the Sept 2013 & June 2012 year 2. a written corrective action statement for the above violation HW & UST for Sept 2013 & June 2012 yr 3. a photographic evidence that the used fuel filter drum is properly labeled ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
