TO: Fire Districts, Sheriff's Office, CDD staff FROM: CDD Code Enforcement RE: Board and Secure process Purpose: To effectively respond to requests for emergency securements where there are conditions that pose an immediate threat of life, limb, health, safety or welfare of anyone, or of threat of loss of property. Authority: San Joaquin County Ordinance Code, Title 8, Division 5, Chapter 3, Section 8-5200 Emergency Abatement. Whenever the Board of Supervisors or the enforcement agency determines that a condition poses an immediate threat of life, limb, health, property, safety or welfare of anyone, the enforcement agency may act to immediately notify the owner of the real property involved that the condition must be abated immediately. If, after making a good faith effort, the enforcement agency is unable to contact the owner within a reasonable period of time, or after contact and failure to comply, the Board of Supervisors or the enforcement agency may cause the abatement of the condition which poses an immediate threat. Process: 1. Prior to requesting an immediate securement, the Requesting Agency, usually Fire or Sheriff's Office personnel, will take all necessary steps to locate the property owner or other responsible party to secure the property. Requesting Agency personnel should only request securement when no responsible party is available and leaving the property unsecured would result in immediate harm to person or in additional loss and/or damage of the property. In cases that do not pose an immediate threat, staff will respond during normal working hours. 2. Requesting Agency personnel will contact CDD staff at 209-468-3141 and provide the following information, staff will monitor the messages left on this line outside of normal business hours: The condition, or conditions, that pose the immediate threat to health and safety or property. Location of the property: site address, APN, cross street, etc. Requesting agency contact person name and phone number Fire or Sheriff's Office report number, if available. Description of the attempts made by the Requesting Agency to locate the property owner or responsible party. Location and size of the area to be secured. 3. In addition to the efforts made by the Requesting Agency, CDD staff will attempt to notify the property owner/responsible party.
