SANdOAQUIN <br /> <br />Community Development Department <br />COUNTY — Planning • Building • Code Enforcement • Fire Prevention • GIS <br />Greatness grows here. <br />TO: Fire Districts, Sheriff's Office, CDD staff <br />FROM: CDD Code Enforcement <br />RE: Board and Secure process <br />Purpose: To effectively respond to requests for emergency securements where there are <br />conditions that pose an immediate threat of life, limb, health, safety or welfare of anyone, or of <br />threat of loss of property. <br />Authority: San Joaquin County Ordinance Code, Title 8, Division 5, Chapter 3, Section 8-5200 <br />Emergency Abatement. <br />Whenever the Board of Supervisors or the enforcement agency determines that a <br />condition poses an immediate threat of life, limb, health, property, safety or welfare of anyone, the <br />enforcement agency may act to immediately notify the owner of the real property involved that the <br />condition must be abated immediately. <br />If, after making a good faith effort, the enforcement agency is unable to contact the <br />owner within a reasonable period of time, or after contact and failure to comply, the Board of <br />Supervisors or the enforcement agency may cause the abatement of the condition which poses an <br />immediate threat. <br />Process: <br />1. Prior to requesting an immediate securement, the Requesting Agency, usually Fire or <br />Sheriff's Office personnel, will take all necessary steps to locate the property owner or <br />other responsible party to secure the property. Requesting Agency personnel should <br />only request securement when no responsible party is available and leaving the property <br />unsecured would result in immediate harm to person or in additional loss and/or damage <br />of the property. In cases that do not pose an immediate threat, staff will respond during <br />normal working hours. <br />2. Requesting Agency personnel will contact CDD staff at 209-468-3141 and provide the <br />following information, staff will monitor the messages left on this line outside of normal <br />business hours: <br />The condition, or conditions, that pose the immediate threat to health and safety <br />or property. <br />Location of the property: site address, APN, cross street, etc. <br />Requesting agency contact person name and phone number <br />Fire or Sheriff's Office report number, if available. <br />Description of the attempts made by the Requesting Agency to locate the <br />property owner or responsible party. <br />Location and size of the area to be secured. <br />3. In addition to the efforts made by the Requesting Agency, CDD staff will attempt to notify <br />the property owner/responsible party.
