A lip liner, determined to be a hazardous waste, was incorrectly placed in the Flammables StrongPak tote, <br />while the "Zebra" scanner stated to place the lip liner into the Toxic StrongPak tote. Also, two StrongPak bags, one <br />containing make-up and the other containing a bottle of shampoo, were placed in a red "OTC" return basket at the <br />front of the facility, rather than being placed in the proper hazardous waste storage totes. The generator must <br />ensure that all employees who handle hazardous waste are thoroughly familiar with proper waste handling and <br />emergency procedures. Provide proof of training to the EHD for employees whose responsibilities include <br />hazardous waste. <br />This is a minor violation. <br />110 <br />CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br />Manifest numbers 0011387216FLE (5/16/18) and 0011387215FLE (5/16/18) were found without a signed off copy <br />from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the <br />destination facility on site for three years and have them readily available for review. If the generator did not receive <br />a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's <br />waste was submitted within 60 days of the date the waste was accepted by the initial transporter, the generator shall <br />submit a legible copy of the missing manifest, with some indication that the generator has not received confirmation <br />of delivery. This information shall be submitted to: <br />DTSC Report Repository <br />Generator Information Services Section <br />P.O. Box 806 <br />Sacramento, CA 95812-0806 <br />Immediately locate a copy of the missing manifests or prepare and submit the required information to DTSC. <br />Submit to the EHD a copy of the signed off copy of the manifest or a copy of the information submitted to DTSC. <br />This is a Class II violation. <br />201 <br />HSC 25163(a) Transported or transferred hazardous waste to a transporter without valid registration. <br />Documentation in the pharmacy indicates that nine 10 MG tablets of Warfarin Sodium were sent to Genco. The <br />pharmacist, Chao Vang, stated that pharmaceutical drugs are mailed to Genco via USPS. Transportation of <br />hazardous waste shall be performed only a person that holds a valid registration issued by the Department of Toxic <br />Substances Control to transport hazardous waste. Immediately begin using a registered hazardous waste hauler to <br />transport any generated hazardous wastes. <br />This is a Class I violation. <br />203 <br />HSC 25189.5(c) Transported or caused transportation of hazardous waste to an unauthorized point. <br />Documentation in the pharmacy indicates that nine 10 MG tablets of Warfarin Sodium were sent to Genco. Genco <br />does not have a permit from the Department of Toxic Substance control (DTSC) to received hazardous waste. No <br />person shall transport or cause transportation of hazardous waste to a facility which does not have a permit from <br />DTSC.
