At the time of inspection, it could not be demonstrated that employees who handle hazardous waste were properly trained. A lip liner, determined to be a hazardous waste, was incorrectly placed in the Flammables StrongPak tote, while the "Zebra" scanner stated to place the lip liner into the Toxic StrongPak tote. Also, two StrongPak bags, one containing make-up and the other containing a bottle of shampoo, were placed in a red "OTC" return basket at the front of the facility, rather than being placed in the proper hazardous waste storage totes. The generator must ensure that all employees who handle hazardous waste are thoroughly familiar with proper waste handling and emergency procedures. Provide proof of training to the EHD for employees whose responsibilities include hazardous waste. This is a minor violation. 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. Manifest numbers 0011387216FLE (5/16/18) and 0011387215FLE (5/16/18) were found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 60 days of the date the waste was accepted by the initial transporter, the generator shall submit a legible copy of the missing manifest, with some indication that the generator has not received confirmation of delivery. This information shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifests or prepare and submit the required information to DTSC. Submit to the EHD a copy of the signed off copy of the manifest or a copy of the information submitted to DTSC. This is a Class II violation. 201 HSC 25163(a) Transported or transferred hazardous waste to a transporter without valid registration. Documentation in the pharmacy indicates that nine 10 MG tablets of Warfarin Sodium were sent to Genco. The pharmacist, Chao Vang, stated that pharmaceutical drugs are mailed to Genco via USPS. Transportation of hazardous waste shall be performed only a person that holds a valid registration issued by the Department of Toxic Substances Control to transport hazardous waste. Immediately begin using a registered hazardous waste hauler to transport any generated hazardous wastes. This is a Class I violation. 203 HSC 25189.5(c) Transported or caused transportation of hazardous waste to an unauthorized point. Documentation in the pharmacy indicates that nine 10 MG tablets of Warfarin Sodium were sent to Genco. Genco does not have a permit from the Department of Toxic Substance control (DTSC) to received hazardous waste. No person shall transport or cause transportation of hazardous waste to a facility which does not have a permit from DTSC. Immediately cease the transportation of hazardous waste to unauthorized locations. This is a Class II violation.
