Stacy Rivera <br />San Joaquin County <br />Environmental Health Department -5- December 7, 2022 <br /> <br /> <br /> <br />Response: The facility will ensure all operated UST systems have approved overfill prevention <br />system going forward <br /> <br />Item #320 CCR 2635(c)(1) Overfill prevention was overridden. <br />OBSERVATION: The mechanical overfill prevention device on the 91 UST was <br />overridden by sending fuel directly into the body of the tank, as per Jones Covey Group. <br /> <br />REGULATION GUIDANCE: All underground storage tanks shall be equipped with an <br />overfill prevention device that does not allow for manual override and either shuts off or <br />restricts flow into the tank. <br /> <br />CORRECTIVE ACTION: Take all necessary precautions to prevent overfill prevention <br />devices from being overriden in the future. <br /> <br />This is a Class I violation. <br /> <br />Response: The facility will take all necessary precautions to prevent overfill prevention devices from <br />being overriden in the future <br /> <br />Item #327 CCR 2638(a), 2641(j) Leak detection equipment not <br />installed/calibrated/operated/maintained per manufacturer instructions. <br />OBSERVATION: Leak detection equipment was not verified previous to adding fuel to the <br />91 fuel tank. Fuel was deposited into the 91 tank on 8/29/22, without conducting required <br />testing of the monitoring equipment. Functionality testing was observed on 8/30/22. <br /> <br />REGULATION GUIDANCE: All monitoring equipment shall be installed, calibrated, <br />operated, and maintained in accordance with manufacturer's instructions, and certified for <br />operability, proper operating condition, and proper calibration. Immediately contact a <br />properly licensed and certified contractor to verify all monitoring equipment. <br /> <br />CORRECTIVE ACTION: Ensure that all operated leak detection equipment is properly <br />properly programmed, tested, and maintained at all times on all tanks going forward. <br /> <br />Response: The facility will take all ensure that all operated leak detection equipment is properly <br />programmed, tested, and maintained at all time going forward <br /> <br />We believe that the above statement, along with the enclosed documents, address all inspection comments <br />from your report dated November 8, 2022. <br />
