The following is an itemized list of hazardous waste violations that have not been <br />addressed for SJC FAIRGROUNDS as of December28, 2017. <br />Open violations from July 20, 2017 inspection <br />Violation #113 - Failed to keep copies of consolidated manifesting receipts for three years. <br />Copies of hazardous waste disposal records for 2015, 2016, 2017 were not found on site. Hazardous waste <br />generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a <br />consolidated manifesting procedure on site for three years and have them readily available for review. Immediately <br />locate a copy of all manifests and receipts for the last three years, maintain them on site, and submit copies to the <br />EHD. <br />Violation #301 - Facility not maintained to minimize the release of a hazardous waste. <br />2 areas near the toilet storage building had dark oily staining in the dirt. During the business plan inspection, <br />inspector had taken photos of drums leaking in both of these areas. The drums have since been moved near the <br />horse stables, leaving contaminated dirt behind. Facilities shall be maintained and operated to minimize the <br />possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten <br />human health or the environment. Immediately remove the impacted soil, and manage according to Title 22 <br />hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was <br />managed. <br />Violation #303 - Failed to maintain all communication or alarm systems, spill control, or decontamination <br />equipment. <br />-Eye wash near pesticide room had not been maintained. When Skip pushed the handle to turn it on, black oily <br />liquid squirted out. <br />-Spill control pallet under 55g drums seen near the horse stalls had black oily liquid in. Spill control equipment must <br />be maintained clean and dry in order to be used in case of an emergency. <br />All facility communications or alarm systems, fire protection equipment, spill control equipment, and <br />decontamination equipment, where required, shall be tested and maintained as necessary to assure its proper <br />operation in time of emergency. Immediately begin this practice. <br />Violation #403 - Failed to keep hazardous waste containers closed except when adding or removing <br />hazardous waste. <br />At time of inspection: <br />white poly container in the shop with waste oil was open. <br />1 5g bucket with yellow container and freestanding waste oil was open. <br />1 55g metal drum with a hazardous waste label had a drain container in the bung hole and was open <br />All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately <br />close these containers and ensure all hazardous waste containers are closed when not adding or removing waste. <br />Violation #404 - Failed to inspect hazardous waste storage areas at least weekly. <br />Hazardous waste containers are not inspected weekly. Hazardous waste container storage and transfer areas shall <br />be inspected weekly for leaking containers and for deterioration of containers and the containment system caused <br />by corrosion and other factors. Immediately begin conducting the necessary weekly inspections for all hazardous <br />waste containers at this facility. <br />Violation #601 - Stored hazardous waste onsite greater than 180 days. <br />At time of inspection: <br />1 55g drum of used oil had a start accumulation date of 2011. <br />Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste <br />stored on site at any time may store waste on site up to 180 days. Immediately contact a licensed hazardous waste <br />hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD. <br />Note: While it could not be determined what was in the other 30+ 55g drums or the hundreds of 5g buckets with <br />paint labels, if it is determined they are a hazardous waste they also must be removed immediately by a licensed <br />hazardous waste hauler. <br />Page 2 of 4 <br />
