OBSERVATION: This facility has not completed Hazardous Materials Business Plan and submitted electronically to the California Environmental Reporting System (CERS). REGULATION GUIDANCE:As of January 1, 2013, all businesses were required to submit all business plans electronically. CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 3 HSC 25507 Failed to establish and implement a HMBP. OBSERVATION:A Hazardous Materials Business Plan has not been established or implemented at this facility. REGULATION GUIDANCE: A Hazardous Materials Business Plan (HMBP)shall be established and implemented for emergency response to a release or threatened release of a hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and pressure. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD./Submit a statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented. This is a Class II violation. 4 HSC 25508(a)(1) Failed to electronically submit the Business Activities or Owner/Operator Identification page. OBSERVATION: The Business Activities and Business Owner/Operator Identification forms have not been completed and submitted.
