OBSERVATION: Facility does not meet the Ag exemption and failed to complete and submit training program(s). REGULATION GUIDANCE: To meet this exemption, a farming business shall: -annually submit the Hazardous Materials Inventory -mark each building that stores any pesticides, petroleum fuels and oil, or fertilizers with warning signs -provide training for all employees in safety procedures in the event of a release or threatened release of a hazardous material. Training programs for all employees and annual training, including refresher courses, shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened release of a hazardous material.Training shall cover, but not limited to, all of the following: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice,for the business site. These training programs may take into consideration the position of each employee. CORRECTIVE ACTION(S): Immediately take all steps to meet the requirements for exemption from filing a training plan, or log into the CERS at http://cers.calepa.ca.gov/, and upload a training plan for all employees that address annual training, including refresher courses, safety procedures for the event of a release or threatened release of a hazardous material, including, but not limited to,familiarity with the facility's emergency response plans and procedures. These training programs may take into consideration the position of each employee. This is a Class II violation. Overall Inspection Comments: Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were nine violations observed during the inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 02/5/2022. Notes: Consent for taking photos was not granted. Observed several open totes and containers. Ensure all the containers are closed to prevent spill and exposure.
