The following is an itemized list of hazardous materials violations that have not been addressed for RMM FARMS as of July 21, 2022. Open violations from June 06, 2022 inspection Violation#9-Failed to annually review and certify that the HMBP is complete and accurate by the due date. OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. The bsuiness has not made submittal for the year of 2022.The last submittal made was on 1/14/2021. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. ❑ This violation was corrected ❑This violation will be corrected by(date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#10-Failed to electronically update the HMBP within 30 days of substantial change in operations. OBSERVATION: During the inspection, Romi Bhinder stated that the Hazardous Material Business Plan (HMBP) has not been updated to reflect the new ownership since July of 2021.The business has not updated and submitted the information within 30 days. REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) A change of business or facility address d)Change business ownership e)Change of business name f)(1)A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. (2)For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede implementation of the business plan.
