The hazardous waste consisted of 100 gallons of used oil and was <br /> transported in early October 2021 by the facility from 9451 Arbor Ave, Tracy, CA 95304 to 1111 Navy Dr, Stockton <br /> CA 95206. Per President Nilton Ayala,the oil was transported because the business moved locations. The <br /> transporter could not provide valid hazardous waste transporter registration or manifest records during the <br /> inspection. <br /> VIOLATION GUIDANCE: California Health &Safety Code section 25163(a) <br /> CORRECTIVE ACTION: Immediately cease allowing transportation of hazardous waste by a transporter without <br /> valid hazardous waste registration issued by the California Department of Toxic Substances Control. Provide a <br /> corrective action statement and supporting documentation to the San Joaquin County Environmental Health <br /> Department within 30 days. <br /> This is a Class I violation. <br /> 203 HSC 25189.5(c)Transported or caused transportation of hazardous waste to an unauthorized point. <br /> OBSERVATION: Per President Nilton Ayala, Power Lane Logistics Inc moved locations and transported 100 <br /> gallons of used oil from 9451 Arbor Ave,Tracy, CA 95304 to 1111 Navy Dr, Stockton CA 95206. Hazardous wastes <br /> shall be disposed of only by transportation to a permitted hazardous waste treatment, storage, and disposal facility <br /> (TSDF)or other authorized point. <br /> REGULATION GUIDANCE: Any person who knowingly transports or causes the transportation of hazardous waste, <br /> or who reasonably should have known that he or she was causing the transportation of any hazardous waste,to a <br /> facility which does not have a permit from the department issued pursuant to this chapter, or at any point which is <br /> not authorized according to this chapter, shall, upon conviction, be punished by imprisonment in a county jail for not <br /> more than one year or by imprisonment pursuant to subdivision (h)of Section 1170 of the Penal Code. <br /> CORRECTIVE ACTION: Immediately cease transportation of all hazardous waste to the new business location. <br /> Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> An inspection checklist was provided to the facility operator on the day of inspection.
