The <br />request was filed under Section 9-9106, which allows for a change <br />in conditions when the requirement or conditions of approval of <br />the Tentative Map are not reasonable or are in need of clarifica- <br />tion. The approving body may, upon written application of the <br />subdivider or owner, modify such request, requirement or <br />condition. <br />BACKGROUND <br />On August 2, 1984 the Planning Commission conditionally approved <br />the Subdivision. Dave Olmstead, representing the applicant, <br />appealed a condition requiring conditional drainage. The Board <br />of Supervisors, at its meeting of October 25, 1984, referred the <br />application back to the Planning Commission for reconsideration <br />of storm drainage. From October 25, 1984 to June 6, 1985 the <br />applicant worked with the Department of Public Works to revise <br />storm drainage requirements. On June 6, 1985 the Planning <br />Commission heard the Subdivision application and considered the <br />matter of storm drainage. The Commission approved the Sub- <br />division with community ponding as the method of storm drainage. <br />The applicant appealed the Commission's action to the Board of <br />Supervisors. The Board of Supervisors, on July 23, 1985 approved <br />drainage by individual ponding rather than by community ponding. <br />The applicant is now requesting reconsideration regarding improve- <br />ments to Fairoaks Road. The applicant's opinion is that the <br />Commission did not require improvements along Fairoaks Road <br />as stated in the condition approved by the Commission October 2, <br />1984, in Condition 2 (j). See the attached list of conditions. <br />This condition states that full street width improvements are <br />required on the Subdivision side in compliance with County stan- <br />dards with a ten foot setback along the right-of-way. The right- <br />of-way for Fairoaks Road is projected at 60'. Therefore, the 10' <br />dedication should be 5' rather than 10'. It should be -a, <br />dedication. <br />The applicant and staff have reviewed the tape of the meeting of <br />August 2, 1984. Staff's opinion is that there should be a dedi- <br />cation of 5' along Fairoaks Drive, and that the Fairoaks Road <br />should be brought up to County standards on the Subdivision side. <br />The applicant does not agree with this opinion. <br />Section 9-9340 states, in part, that whenever a Subdivision <br />includes or is adjacent to any part of the public roadway, the <br />
