ORDINANCE NO. 4090 <br /> ADOPTED BY THE SAN JOAQUIN COUNTY BOARD <br /> OF SUPERVISORS ON DATE OF <br /> OCTOBER 17, 2000 <br /> AN ORDINANCE OF THE COUNTY OF SAN JOAQUIN APPROVING THE SECOND <br /> AMENDMENT TO A DEVELOPMENT AGREEMENT BY AND BETWEEN COUNTY OF SAN <br /> JOAQUIN AND BAY CITIES TRUCK STOP, TRACY INDUSTRIAL PARTNERS AND <br /> KING & LYONS-TRACY INDUSTRIAL, DATED DECEMBER 4, 19°0 . <br /> Be it Ordained by the Board of Supervisor of the County of San <br /> Joaquin as follows: <br /> Section 1 . This Ordinance incorporates, and by this reference <br /> makes a part hereof, Second Amendment to a Development Agreement, <br /> attached hereto. That Development Agreement is by and between <br /> County of San Joaquin and Bay Cities Truck Stop, Tracy Industrial <br /> Partners and King & Lyons-Tracy Industrial, dated December 4, 1990. <br /> Section 2 . This Ordinance is adopted And rpursuant theuhors authorityof <br /> Government Code Section 65864 et seq. <br /> he <br /> provisions of Division 13 of Title 9 to the Ordinance Code of San <br /> Joaquin County, which was added by County' s Ordinance No. 3675, <br /> establishing procedures and requirements for consideration of <br /> development agreements pursuant to Government Code Section 65864 et <br /> seq. , (hereafter the "Development Agreement Regulation") . <br /> Section 3. The Board of Supervisors hereby finds and <br /> determines that the Second Amendment to the Development Agreement <br /> is consistent with the General Plan. of the County of San Joaquin. <br /> A Negative Declaration pertaining the Second Amendment to the <br /> Development Agreement was approved by the Board of Supervisors on <br /> October 17, 2000 by Board Order No. B-00-1271. <br /> Section 4 . The Chairman and Clerk of the Board of Supervisors <br /> are hereby authorized and directed to execute the Second Amendment <br /> to the Development Agreement on behalf of the County of San Joaquin <br /> after the effective date of this Ordinance. <br /> Section 5. The effective date of the Second Amendment to the _- <br /> Development Agreement shall be the effective date of this <br /> Ordinance. <br /> Section 6. Within ten (10) days after the effective date of <br /> this Ordinance, the Clerk shall record the Second Amendment to the <br /> __ -Development -Agreement and this Ordinance- with the County- Recorder.- <br /> - of the County of San Joaquin. <br />
