Box 1810 FERMIT/SERVICES Stockton, CA 95201 Re: BEAR CREEK TERRACE III CONDITIONS OF APPROVAL ! Dear Tom: I have no problems with the conditions of approval for the above, except for the time frame. Section 2 of the conditions puts us in a Catch 22 situation. The Developer has agreed to give the District approximately $200,000.00 upon the approval of this project,to fund a new well and an enlargement to the treatment facilities. He has also agreed not to request any occupancy permits until the District has constructed the necessary improvements to service the project. (Please see letters from Frank Johnson Jr. , January 6, 1986 and the L.C.S.D. , December 31 , 1985. ) To make a long story short, banks do not want to lend money until the subdivision map is recorded. The District needs a great deal of money which the Developer has agreed to pay in advance of the normal time requirement. Water and sewer services would not physically be provided by the District until such time as occupancy permits are issued for the houses. We request that item 2 be modified so that no occupancy permits be granted prior to the completion of the necessary facilities by the L.C.S.D. and their approval of various agencies. To require the above prior to the filing of the final map, could remove the .funding for the improvements. I have discussed this with Mr. Carl Borgman and Al Olson of the Health District.
