Box 1810 FERMIT/SERVICES <br /> Stockton, CA 95201 <br /> Re: BEAR CREEK TERRACE III <br /> CONDITIONS OF APPROVAL ! <br /> Dear Tom: <br /> I have no problems with the conditions of approval for the above, <br /> except for the time frame. Section 2 of the conditions puts us in <br /> a Catch 22 situation. <br /> The Developer has agreed to give the District approximately $200,000.00 <br /> upon the approval of this project,to fund a new well and an enlargement <br /> to the treatment facilities. He has also agreed not to request any <br /> occupancy permits until the District has constructed the necessary <br /> improvements to service the project. (Please see letters from Frank <br /> Johnson Jr. , January 6, 1986 and the L.C.S.D. , December 31 , 1985. ) <br /> To make a long story short, banks do not want to lend money until <br /> the subdivision map is recorded. The District needs a great deal <br /> of money which the Developer has agreed to pay in advance of the <br /> normal time requirement. Water and sewer services would not physically <br /> be provided by the District until such time as occupancy permits are issued <br /> for the houses. <br /> We request that item 2 be modified so that no occupancy permits be <br /> granted prior to the completion of the necessary facilities by the <br /> L.C.S.D. and their approval of various agencies. To require the above <br /> prior to the filing of the final map, could remove the .funding for the <br /> improvements.
