Permittee shall meet all applicable regulations under subtitles C and D of the Resource 1 <br /> Conservation and Recovery Act, and 40 CFR Parts 260 through 271, and any applicable <br /> State regulations promulgated subsequent to the Federal law. <br /> 27. Permittee shall prepare and submit a slug discharge control plan within 60 calendar days <br /> from the effective date of this permit, unless otherwise determined and specified by the <br /> City of Stockton Environmental Control Section. All spills and slug discharges to the <br /> sanitary sewer system must be reported immediately to the City of Stockton Environmental <br /> Control Section. <br /> 28. It is recommended that the permittee develop and implement a water conservation plan <br /> and a hazardous waste minimization plan. Such plans may be required by this permit. <br /> 29. The discharge of excess amounts of pollutants specifically limited and deviations of pH <br /> may be subject to fines for each violation. <br /> 30. Achieving permit conditions of specific pollutant concentration limits by dilution is <br /> expressly prohibited. Any evidence of this, either willfully or through negligence, will result <br /> in permit limits being redefined in terms of maximum effluent loadings. Additionally, <br /> penalties of a maximum of$25,000 per calendar day may be assessed (SMC 13.08.440). <br /> 31. Notification of Potential Problems: <br /> a. In the case of any discharge, including, but not limited to, an accidental discharge; <br /> a discharge of a nonroutine, episodic nature; a noncustomary batch discharge; or <br /> a slug discharge or slug load that might cause potential problems for the POTW; <br /> or any discharge at a flow rate or concentration which could violate the discharge <br /> standards set forth in Stockton Municipal Code Section 13.08.100, the User shall <br /> immediately telephone and notify the City of Stockton, Environmental Control <br /> Office, of the incident. This notification shall include the location of the discharge, <br /> type of waste, concentration and volume, if known,and corrective actions taken by <br /> the User. <br /> b. Within five(5)days following such discharge,the User shall submit to the Municipal <br /> Utilities Department a detailed written report describing the cause(s) of the <br /> discharge and the measures to be taken by the User to prevent similar future <br /> occurrences. Such notification shall not relieve the User of any expense, loss, <br /> damage, or other liability which might be incurred as a result of damage to the <br /> POTW, natural resources, or any other damage to person or property; nor shall <br /> such notification relieve the User of any fines, penalties,or other liability which may <br /> be imposed pursuant to the Stockton Municipal Code. <br /> C. A notice shall be permanently posted on the Users bulletin board or other <br /> prominent place advising employees who to call in the event of a discharge <br /> described in paragraph A, above. Employers shall ensure that all employees, who <br /> could cause such a discharge to occur, are advised of the emergency notification <br /> procedures. <br />
