Pretreatment Industrial Users <br /> General Permit Conditions Page <br /> 14 of 14 <br /> filed or required to be maintained pursuant to SMC Chapter 13.08 or this permit, or which <br /> falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method <br /> required under SMC Chapter 13.08. The criminal penalty shall be issued by the City <br /> Attorney or County District Attorney and shall include all penalties authorized in SMC <br /> Chapter 13.08. The penalty shall be consistent with the Federal Clean Water Act, 33 <br /> U.S.C. 1251, at seq., and amendments thereto, and any relevant State laws. The user <br /> shall, upon conviction, be guilty of a misdemeanor, punishable by a fine not to exceed <br /> $1,000 or imprisonment for not more than six (6) months, or both, per violation per <br /> calendar day.The penalty shall be consistent with the Federal Clean Water Act, 33 U.S.C. <br /> 1251, et seq., and amendments thereto,and shall apply to the exclusion of any other more <br /> lenient provisions of SMC Chapter 13.08. A user shall be guilty of a separate violation of <br /> each calendar day for a violation of any provision of this permit or SMC Chapter 13.08. <br /> 45. Alternative Interim Local Limits: The Director shall,from time to time, establish alternative <br /> interim local limitations applicable to Industrial wastewater discharges when in the <br /> Director's judgment it is necessary to protect the City's' sewer collection and treatment <br /> system or to be in compliance with state, local or federal regulations. These interim limits <br /> are either alternatives to the established local limits or new alternative limits and can be <br /> either more or less stringent than the established local limits, based on a reasonable <br /> determination by the Director.The Director shall establish these alternative quantitative or <br /> qualitative local limitations for dischargers which, because of their location, quantity or <br /> quality of discharge, can degrade the quality of wastewater treatment plant effluent or <br /> residue or air quality to a level that prevents or inhibits the City's efforts to reuse or dispose <br /> of the water or residue or causes any unusual operation or maintenance problems in the .r <br /> sewerage system.The Director, in determining the unacceptability of specific wastes,shall <br /> consider the nature of the waste and the adequacy and nature of the collection, treatment <br /> and disposal system available to accept the waste. These alternative interim limits shall <br /> be applicable until final specific limitations for these constituents are developed and <br /> implemented by the City. <br />
