Exhibit B <br />People v_ Flying JInc. <br />Initial Penalty Payment to Certified Unified Program Agencies ("CUPAs") <br />Paragraph 3 Lb. <br />Flying J shall pay $125,000 by a company check made payable to the "Kern County <br />Environmental Health Department." <br />Flying J shall pay $200,000 by a company check made payable to the "Los Angeles <br />County Department of Public Works." <br />Flying J shall pay $125,000 by a company check made payable to the "Riverside County <br />Department of Environmental Health Hazardous Materials Division." <br />Flying J shall pay $125,000 by a company check made payable to the "San Bernardino <br />County Fire Department." The check shall bear on its face the CUPA's internal docket number <br />for this matter ("RKE-106-107-9970 Flying J"). <br />Flying J shall pay $235,000 by a company check made payable to "San Joaquin County <br />Environmental Health Department." <br />Each check required by Paragraph 3 Lb. shall bear on its face the case name ("People v. <br />Flying J") and the Superior Court docket number, and any additional CUPA-specific information <br />specified above. <br />Before any CUPA identified in this Exhibit may receive its payment, that agency must <br />first identify a special account and submit to the People's representatives, as identified in <br />Paragraph 8, a declaration by an authorized representative of that agency stating that the funds <br />deposited into the special account pursuant to this Consent Judgment shall be expended only to <br />fund the activities of that agency in enforcing Chapter 6.7, Division 20, Health and Safety Code <br />within the agency's jurisdiction pursuant to Chapter 6.11, Division 20, Health and Safety Code. <br />The declaration shall follow the format outlined in Exhibit C, which is attached to the Consent <br />Judgment and incorporated by reference. Each CUPA identified in this Exhibit shall be served <br />with a copy of the Consent Judgment after it is entered by the Court. If an agency identified in <br />Exhibit B does not submit the declaration required by this Paragraph within three hundred sixty- <br />five (365) days of the service of the Consent Judgment on that agency, that agency's share of the <br />civil penalties shall be distributed by the Payment Administrator to the State Water Pollution <br />Cleanup and Abatement Account in the State Water Quality Control Fund. <br />People v.
