MAINTENANCE AND OPERATIONAL EXPENSES : (Continued ) <br /> The remedies available to the association against owners who are de- <br /> linquent in the payment of assessments are set forth in the CC&R' s . <br /> These remedies are available against the subdivider as well as <br /> against other owners. <br /> The subdivider has deposited funds in escrow as partial security for <br /> his obligation to pay these assessments. The governing body of the <br /> association should assure itself that the subdivider has satisfied <br /> his obligations to the association with respect to the payment of <br /> assessments before agreeing to a release or exoneration of the <br /> security. <br /> This development is a conversion of an existing mobilehome park to <br /> common interest with exclusive use areas . The common area <br /> facilities were built in 1972 and are being renovated. <br /> TITLE: Title is vested in Tower Park Village, a joint venture of <br /> Triangle Auto Sales , Inc. , a California corporation and Tower Park, <br /> Inc. , a California corporation. <br /> A title report shows title, among other things, to be subject to : <br /> Any adverse claim based upon the assertion" that some portion of said <br /> land is tide or submerged land, or has been created by artificial <br /> means or has accreted to such portion so created. <br /> Any adverse claim based upon the assertion that some portion of said <br /> land has been brought within the boundaries thereof by an evulsive <br /> movement of the Little Potato Slough or has been formed by accretion <br /> to any such potion. <br /> EASEMENTS: Easements for utilities , drainage , rights of way and <br /> other purposes are shown on the Title Report and Subdivision Map <br /> recorded in the Office of the San Joaquin County Recorder, Book 26 <br /> of Maps and Plats, Page 43. <br /> RESTRICTIONS : This subdivision is subject to Restrictions recorded <br /> in the Office of the San Joaquin County Recorder, on December 8 , <br /> 1982, as Instrument Number 82072002. <br /> FOR INFORMATION AS TO YOUR OBLIGATIONS AND RIGHTS , <br /> YOU SHOULD READ THE RESTRICTIONS . THE SUBDIVIDER <br /> SHOULD MAKE THEM AVAILABLE TO YOU. <br /> MINERAL RIGHTS : You will not own the mineral, oil , gas and other <br /> hydrocarbon substances rights under your land below a depth of 500 <br /> feet.
