SAN JOAQUIN <br /> Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: AAA NORTHERN CALIFORNIA, NEVADA & UTAH Date: Apr 30, 2021 <br />RP Mailing Address: 2381 GOLD RIVER ROAD, SUITE B Record ID#: C00053744 <br />GOLD RIVER, CA 95670- Program Element: 2546 <br />Spill Location: N 1-5 , Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGENVASTE RELEASE: <br />APPROXIMATELY 45 GALLONS OF DIESEL FUEL SPILLED ONTO SOIL. CAL OES CONTROL #:21-2304. <br />OBSERVATIONS: <br />April 30, 2021: EHD received notification of a diesel fuel spill onto northbound 1-5 shoulder due to a traffic collision. Met with <br />California Highway Patrol and CALTRANS personnel. Approximately 45 gallons of diesel fuel spilled from a saddle tank on <br />AAA tow truck (License Plate #: 75470W2) and impacted the soil shoulder in scattered areas. CALTRANS determined a <br />USA dig notification is required for cleanup. NRC Environmental was contracted for cleanup and plan to commence <br />excavation of diesel-impacted soil areas on the week of May 3rd pending USA clearance. Please be aware that all impacted <br />soil has to be excavated and disposed of under the appropriate waste manifesting procedure [HSC 25160 (b)(3)]. The <br />disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility which is not permitted <br />or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Notify EHD (48-hours) in advance of any cleanup activities. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25/89.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />cl Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Provide disposal records for all generated wastes. <br />11 Other Correction <br /> <br />EHD 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />Page 1 of 2 <br />1868 E.
