The following is an itemized list of hazardous materials violations that have not been <br /> addressed for J & H MARINE INC as of September26, 2022. <br /> Open violations from February 08, 2022 inspection <br /> Violation #9 - Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> OBSERVATION The business plan information has not been reviewed and resubmitted in the California <br /> Environmental Reporting System (CERS) annually by the due date, January 15. Business plan was last submitted <br /> on 7/15/2020. <br /> Business plan was submitted late for 2019 . <br /> Business plan was submitted late in 2020. <br /> Business plan was not submitted for 2021 , and 2022. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year <br /> CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br /> annual HMBP to CERS by January 15. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date) : <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation #11 - Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> OBSERVATION Proof of training could not be provided at time of inspection. <br /> REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br /> receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a <br /> release or threatened release of a hazardous material , including , but not limited to, familiarity with the following <br /> plans and procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> (C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br /> years. <br /> CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br /> training records to the EHD. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Page 2 of 2 <br />
