The following is an itemized list of hazardous materials violations that have not been addressed for J & H MARINE INC as of November 22 , 2022 . Open violations from February 08, 2022 inspection Violation #9 - Failed to annually review and certify that the HMBP is complete and accurate by the due date. OBSERVATION The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date , January 15 . Business plan was last submitted on 7/ 15/2020 . Business plan was submitted late for 2019 . Business plan was submitted late in 2020 . Business plan was not submitted for 2021 , and 2022 . REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION : Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15 . ❑ This violation was corrected ❑ This violation will be corrected by ( date) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #11 - Failed to provide or document initial and/or refresher training to appropriate personnel . OBSERVATION Proof of training could not be provided at time of inspection . REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training . All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material , including , but not limited to , familiarity with the following plans and procedures : (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency . ( B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons , property , or the environment (C ) Evacuation plans and procedures , including immediate notice , for the business site . This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years .
