AGREEMENT <br /> WHEREAS, LANDOWNER, without prior approval, has re- <br /> moved, reconstructed, filled in, or altered said improve- <br /> ments in such a manner as to make them nonfunctional or <br /> less efficient; and <br /> WHEREAS, LANDOWNER agrees to hold DEVELOPER, its <br /> officers, agents, and employees harmless for and defend <br /> against any and all claims and liabilities arising from <br /> this agreement, including, but not limited to, damage to <br /> adjacent landowners resulting from the runoff of .
