(b) Upon determination by COUNTY, in its sole dis- cretion, that said improvements must be returned to a condition so as to comply with the requirements of the final subdivision map as filed by DEVELOPER, COUNTY agrees to so notify LANDOWNER in writing and permit LANDOWNER a reasonable time, not to exceed three (3) months, to recon- struct or reinstall said improvements. 2. OBLIGATION OF LANDOWNER. LANDOWNER agrees as follows: (a) Upon written notice from COUNTY, to reconstruct or reinstall improvements to a condition so as to comply with the final subdivision map requirements for the sub- division in which LANDOWNER'S real property is located. (b) To hold COUNTY, its officers, agents, and employees harmless for and defend against any and all claims and liabil- ities arising from this agreement, including, but not limited to, damage to adjacent landowners resulting from the runoff of LANDOWNER'S drainage. Additionally, LANDOWNER agrees to in- demnify COUNTY for any and all losses, including, but not limited to attorneys' fees and legal costs, which COUNTY may suffer by reason of this agreement. 3. OBLIGATION OF DEVELOPER. DEVELOPER agrees to hold COUNTY, its officers, agents, and employees, harmless for and defend against any and all claims and liabilities arising from this agreement, in- cluding, but not limited to, damage to adjacent landowners resulting from the runoff of LANDOWNER'S drainage. Additionally, DEVELOPER agrees to indemnify COUNTY for any and all losses, including, but not limited to, attorneys' fees and legal costs, which COUNTY may suffer by reason of this agreement. 4. TERM. Subject to earlier termination as herein provided, the term of this agreement shall be for an indefinite period ter- minating: (a) At such time as COUNTY, within its sole discretion, notifiee LANDOWNER in writing of its intention to require the reinstallation or reconstruction of improvements as provided 2 -
