"Tracy MRF/TS hereby certified that no waste has been buried or land <br /> applied on-site since 2000." <br /> A^ <br /> Mike Repetto, Prdsident May 15, 2007 <br /> Tracy MRF/TS is perplexed on the recent addition to the CIWMB "IWIVIA Fee <br /> Disposal Site " list where we have received four "Notice of Delinquency" letters <br /> on May 2, 2007 from the BOE for activity back to 2000 . The process to add <br /> facilities to the CIWMB list should include notification to the operator and the <br /> Local Enforcement Agency to verify presumed disposal activity before alerting <br /> the BOE. The process to be added to the list should be extensive before the BOE <br /> sends out threatening letters. <br /> We have tried to contact the BOE on this issue by phone and recently spoke with <br /> Monique Everson. Tracy MRF/Ts will be providing the BOE with a "Power of <br /> Attorney" Form to allow Evan W.R. Edgar to represent us on this case, which <br /> would allow Mr. Edgar to discuss the matter with the BOE, in order to show the <br /> BOE that Tracy MRF/TS is making a good faith effort to remove the facility from <br /> the CIWMB list and to have the BOE letters rescinded. We are copying the BOE <br /> on this letter. <br /> Tracy MRF/TS looks forward to having this situation resolved soon.
