FINDINGS FOR SITE APPROVAL <br /> PA-2t ooz�t <br /> HOWARD LAND CO.LP/DEVCON CONSTRUCTION INC. <br /> t) Tha proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Mastar Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> This finding can be made because the Educational Services-Commercial Us¢Type may be <br /> condltlonally permitted In the 1-G (General Industrial) zone with an approved Sita Approval <br /> application.Th¢1-G zone implements the G¢n¢ral Plan's 1/G(General Industrial)designation. <br /> Tha subject parcel has a General Plan designation of 1/G and is zoned 1-G. Tharafora, the <br /> use Is consistent with the goals,policies,standards,and maps of the G¢n¢ral Plan.The City <br /> of Lathrop has an approved plan called the North Lathrop Transportation Fea(NLTF)which <br /> requires a fee[o be paid Tor projects based on new vehicle trips.This fee was only adopted <br /> by the City of Lathrop City Cou nail, and was never adopted by the San Joaquin Cou n[y <br /> Board of Supervisors.Tharafora,the NLTF is not applicable to development projects within <br /> the boundaries of unincorporated San Joaquin County.There are no Mastar Plans,Specific <br /> Plans,and/or Spatial Purpose Plans adopted by San Joaquin County in the project vicinity. <br /> 2) Atlequate utilities, roadway improvements, sanitation, water supply, drainage, antl other necessary <br /> facilities have been provided, antl the proposed Improvements are properly related to existing antl <br /> proposed roatlways. ' <br /> This finding can be made because fha 8.27-acre parcel is of adequate size and shape to <br /> accommodate the proposatl LrucK repair school and all necessary Improvements. The alta <br /> plan shows [hal [here is sufficient area for parKing and ctrculation, in compliance with <br /> standards of fha Davalopmen[ Title. Although fha City of Lathrop responded to the Initial <br /> Study/Mitigated N¢gativ¢ Declaration wi[h comments requesting colleeHon of fha NLTF fee, <br /> this fee was only adopted by[ha City of Lathrop City Cou ncll and was never adopted by the <br /> San Joaquin Cou niy Board of Supervisors as required by Government Code 66D02(b). This <br /> code states that capital improvement plans must be adopted by, and annually updated by, <br /> She local jurisdlctlon and adopted ata noticed public hearing. Therefore, the NLTF is not <br /> applicable to development projects within the boundaries of unincorporated San Joaquin <br /> County. The project will b¢served by an on-site wastewater disposal system in accordance <br /> with the Envlronm¢nfal Health Depar[ment standards, on-s Ka terminal storm drainage In <br /> accordance with the Dapar[ment of Public Works standards,antl public water from the Clty <br /> of S[ocKion. Conclusively,fha Impacts from this proposed trueK repair school will b¢ less <br /> than significant. <br /> 3) Th¢site is physically suitable for the type of tlevelopment and for the Intensity of tlevelopment. <br /> This finding can b¢made because fha parcel Is of adequate sizes and shape to accommodate <br /> the proposed uses and the requirements of fha Development Title.
