OBSERVATION: Failed to use containers with material and construction compatible with material stored and conditions of storage such as pressure and temperature. One diesel storage tank(estimated to be able to store 8000 gallons)was found on site,this tank doesn't appear to have adequate emergency venting.This tank was observed on a metal trailer/hitch with tires braced by tire blocks to prevent it from moving. Mr. Henry Rotor indicated that this tank is used for overflow fuel deliveries and has been brought to the site sometime in the last 1-2 years. REGULATION GUIDANCE: (c)(1)Not use a container for the storage of oil unless its material and construction are compatible with the material stored and conditions of storage such as pressure and temperature. CORRECTIVE ACTION: Immediately determine if this container is approved and has appropriate construction for diesel storage. Store oil in containers with material and construction compatible with the material stored and conditions of storage such as pressure and temperature. Ensure that all onsite tanks are properly constructed and are third-party listed for use as Aboveground Storage of Combustible or Flammable Liquids. Submit proof of correction to the EHD. This is a repeat violation, Class Il. 706 CFR 112.8(c)(2)Failed to provide and maintain adequate secondary containment for bulk storage tanks. OBSERVATION: The facility failed to provide and maintain secondary containment for bulk storage tank installations sufficient to hold the capacity of the largest container, including adequate freeboard for precipitation. One diesel storage tank,which appeared to be single walled (estimated to be able to store 8000 gallons)was found on site without adequate secondary containment.This tank was located adjacent to the onsite bulk storage diesel and gasoline tanks. Mr. Henry Rotor indicated that this tank is used for overflow fuel deliveries and has been brought to the site sometime in the last 1-2 years. REGULATION GUIDANCE: (c)(2)Construct all bulk storage tank installations(except mobile refuelers and other non-transportation-related tank trucks)so that you provide a secondary means of containment for the entire capacity of the largest single container and sufficient freeboard to contain precipitation.You must ensure that diked areas are sufficiently impervious to contain discharged oil. Dikes, containment curbs, and pits are commonly employed for this purpose.You may also use an alternative system consisting of a drainage trench enclosure that must be arranged so that any discharge will terminate and be safely confined in a facility catchment basin or holding pond. CORRECTIVE ACTION: Immediately provide and maintain adequate secondary containment for the following bulk storage tank: overflow diesel tank located adjacent(but outsite of the secondary containment)to the bulk diesel and gasoline tanks. Submit proof of correction to the EHD. This is a repeat violation, Class II. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 4/10/2022.
