Environmental Health Department <br />Aboveground Petroleum Storage Act Inspection Report <br />Date: <br />February 24, 2022 <br /> Facility Address: <br /> 1250 E MADRUGA RD, LATHROP <br /> Facility Name: <br /> FOOD EXPRESS INC <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 106 HSC 25404.1.2 Failed to submit a certification and written response within 30 days for minor violations. <br />OBSERVATION: An inspection was last done on 10/2/2018 and an inspection report was issued identifying <br />information to be submitted to bring this site into compliance. This information was required to be submitted by <br />11/1/2018 . This information was received late on 5/16/2019. <br />REGULATION GUIDANCE: 25404.1.2(c)(1) A person who receives a notice to comply detailing a minor violation <br />shall have not more than 30 days from the date of the notice to comply in which to correct any violation cited in the <br />notice to comply. Within five working days of correcting the violation, the person cited or an authorized <br />representative shall sign the notice to comply, certifying that any violation has been corrected, and return the notice <br />to the UPA. <br />CORRECTIVE ACTION: Ensure that a written response documenting corrective actions taken or proposed is <br />submitted within 30 days of receiving an inspection report. <br />This is a Class II violation. <br /> 620 CFR 112.7(f)(1) Failed to train personnel on all discharge prevention details listed in this section. <br />OBSERVATION: The las training record available for review during the inspection was dated 12/31/2020. <br />REGULATION GUIDANCE: (f)(1) At a minimum, train your oil-handling personnel in the operation and maintenance <br />of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan. <br />CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of <br />the training log and training content to the EHD. <br />This is a Class II violation. <br />FA0009618 PR0515716 SC001 02/24/2022 <br />EHD 28-01 Rev. 12/06/2021 Aboveground Petroleum Storage Act OIRPage 5 of 7 <br />1868 E.
