Provided <br /> records document that disposal activities have occurred onthis property since 1977tothe present. <br /> As the result ofthe SJ County DA's office (David (ney, 209-468-2470) 1991 prosecution, the <br /> property owner was ordered to "turn over soil on property, soil brought in bydefendant 2S96 per <br /> year. Soil is to be sifted for hazardous & construction materials which are to be removed. To aOmvv <br /> a search & inspection onthe property by SJ Planning Dept. mtarranged tinnmm'° in addition <br /> $1O,89Ofine/fee was imposed mnthe owner. <br /> ' <br /> The LEA and Cuda Enforcement office <308-468-3184> recently became aware that disposal <br /> activities have resumed and that the property owner did not satisfy the court judgement. The LEA <br /> requested 2138staff tuevaluate this site for possible site cleanup consideration on 5/27/98' <br /> REMARKS: Upon arriving on-aita. the LGA & Code Enforcement officer explained that the ' <br /> property owner had primarily accepted, for a fee, construction/demolition debris from |mco| <br /> contractors and had then buried this material along the western edge of the property against the <br /> elevated berm of the Santa Fe Reil Lina' Reported waste materials accepted and landfilled include <br /> concrete pieces, concrete (asbestos containing) pipe, metal items, scrap lumber, wallboard, asphalt, <br /> ond |ondmcapeourbngo' A /eviavx of records provided indicate that batteries, tires, mattresses, <br /> and automobiles have also been observed inthe fill. Additionally, the records indicate 55- <br /> gallon drums and other containers have been buried on the property. The LEA & Code Enforcement <br /> officer also indicated that the owner routinely burned waste on the property and that in the early <br /> 90m a fire occurred in the fill lasting 1 + month. <br /> We proceeded nowalk the property. An estimated 20tons ofold abandoned farm equipment and <br /> an estimated %O0cubic yards ofconcrete man holes and appliances have been discarded primarily <br /> along the north and east sides ofthe property. Alarge (ondoomAing/vvood waste pile measuring <br /> roughly 50' % 20^ )< 12' (approx. 450yd3) has accumulated in auentra| portion ofthe property. <br /> Landfill disposal activities have primarily occurred onthe west side mfthe property against the Santa <br /> Fe Rail Line. An estimated 500yd3uf miscellaneous trash is scattered over the surface ofthe <br /> property.
