CAL OES CONTROL #: 21-1853. <br />OBSERVATIONS: <br />Arrived to diesel spill site. Observed dark diesel-contaminated soil under the saddle tank from semi truck (license: <br />XP41963). Observed dark oily staining on soil that spilled from truck engine. All Environmental Services arrived on site and <br />determined USA dig notification would be initiated for the removal of the contaminated soil. Please be aware that all <br />impacted soil has to be excavated and disposed of under the appropriate waste manifesting procedure [HSC 25160 (b)(3)1. <br />The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility which is not <br />permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Notify EHD (48-hours) in advance of any cleanup <br />activities. Provide disposal records for all generated wastes. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />c Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
