SANIJOAQUIN <br /> Environmental Health Department <br />—COU <br />' Gf4.:•a:tc <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br /> <br />Responsible Party: MEDLINE INDUSTRIES Date: Apr 23, 2021 <br />RP Mailing Address: 2325W LOUISE AVE <br /> Record ID#: C00053721 <br /> <br />MANTECA, CA 95337- Program Element: 2546 <br />Spill Location: 2325W LOUISE AVE, MANTECA <br /> Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />FUELING CONTRACTOR OVERFILLED THE EMERGENCY BACKUP GENERATOR CAUSING A 1-2 GALLON DIESEL <br />FUEL SPILL. <br />OBSERVATIONS: <br />Met with Kelly Durrer, Medline Industries Regional EHS Manager, on-site and observed dark staining on the north-east <br />corner of the concrete slab beneath the emergency backup generator and the rock around the base of the concrete slab. No <br />storm drains appeared to be impacted. Per Kelly, the rock is 18 inches in depth and soil is beneath the rock. Per Kelly, the <br />fueling contractor, Manfield, used absorbent pads and kitty litter to clean the areas of the generator and concrete slab that <br />were impacted by the spill. Kelly could not determine where Manfield took the used absorbent pads and kitty litter at the time <br />of inspection. Clean-up of the impacted rock and possibly soil has not begun and needs to be completed.. Please be <br />advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is prohibited <br />when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).]. <br />Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting procedure <br />[HSC 25160 (b)(3)]. Provide a waste/hazardous waste disposal records to the EHD for all clean up debris associated with <br />this spill clean up. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />WITHIN 30 DAYS <br />Other Correction <br /> <br />EHD 25-01 Rev. 9/16/2020 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />1868 E.
