Environmental Health Department SANJOAQUIN <br />-COUNTY- <br />Greatness grows here <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: BOB MACHADO <br /> Date: Jan 13, 2022 <br />RP Mailing Address: 22525 S AIRPORT WAY <br /> Record ID#: COXW1XA5Y <br />MANTECA, CA 95337- Program Element: 2546 <br />Spill Location: 22525 S AIRPORT WAY, MANTECA <br /> Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />A 1000 gallon diesel tank is leaking fuel out of the nozzle onto soil. <br />OBSERVATIONS: <br />Per Interim Deputy Fire Marshal Marvin Mears, diesel fuel was leaking out of a nozzle onto the soil beneath it. The EHD <br />went to investigate the release on January 13, 2022 but was denied consent by the business owner, Bob Machado, to <br />inspect the property. Per Interim Deputy Fire Marshal Mears, the site emptied the diesel tank on January 13, 2022 and <br />moved it to the center of the property. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately conduct cleanup of the contaminated area and properly dispose of all waste generated. Contact the EHD <br />for final inspection once the area has been cleaned. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Submit copies of final disposal records and hazardous waste determination documents to the EHD. <br />Other Correction <br /> <br />COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br />rate.
