OBSERVATION: The 91 grade spill container was replaced "like for like"on 10/26/2021 and a permit was not obtained from the EHD. The EHD was notified of the replacement on 11/2/2021. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed,trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the 91 grade spill container. A"Failure to Obtain a Permit" penalty applies. Ensure that EHD is notified 48 hours in advance before testing is conducted. This is a Class II violation. 318 CCR 2635, 2637.1,2665, 2712 Failed to meet spill container requirements. OBSERVATION: The 91 grade spill container failed when tested. REGULATION GUIDANCE:All USTs shall be equipped with a spill container that collects any hazardous substances spilled during delivery operations,that has a minimum capacity of five gallons and a drain valve that allows drainage of the collected spill into the primary container or provide a means to keep the container empty. CORRECTIVE ACTION: The spill container was tightened and retested during the inspection. The spill container passed the retest. This is a Class II violation. 319 CCR 2635, 2637.2,2665, 2712 Failure to comply with overfill prevention equipment requirements. OBSERVATION: Overfill prevention testing was conducted on 10/11/2021. The previous overfill testing was conducted on 9/26/2018. REGULATION GUIDANCE: Overfill prevention equipment inspections were required to be conducted by October 13, 2018, and every 36 months thereafter, and within 30 days of completion of a repair. CORRECTIVE ACTION: Ensure all future testing is conducted within required time frames. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by May 25, 2022. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
