Gau <br /> Senior Civil Engineer <br /> Development Services/ <br /> Engineering Division <br /> SUBJECT: MS-91-105 <br /> ----------------------------------------------------------------- <br /> I am writing in response to your verbal inquiry to me regarding <br /> the status of the tentative map for the above referenced Minor <br /> Subdivision Application in that there is a material discrepancy <br /> or problem with the location of the west property line. <br /> Apparently this property line is approximately 13 feet further to <br /> the east than is shown on the tentative map. <br /> The effect of this error is that the tentative map does not <br /> conform to the requirements of the Development Title and that the <br /> minimum parcel size to be able to be developed with on-site <br /> services in a rural residential zone is two acres. After <br /> consulting the California Subdivision Map Act Practice, Section <br /> 4 . 15 and Subdivision Map Act Sections 66452 . 6 (d) , 66457, 66458 <br /> and 66463 . 5 (b) , it does not appear that the submittal of a parcel <br /> map to the County Surveyor for processing and approval tolls the <br /> time on the expiration of the tentative map. This determination <br /> is based on the fact that the tentative map is in error, does not <br /> conform to the requirements of the Development Title and Section <br /> 66458 (a) of the Subdivision Map Act requires that the map be <br /> denied if it is not in conformance with the local subdivision <br /> ordinance. Because the parcels are less than two acres it does <br /> not conform to the local subdivision ordinance as provided for in <br /> the Development Title. You may want to suggest to Dick Bishop, <br /> the surveyor, that the applicant consider filing a Time Extension <br /> in order to obtain additional time to try and resolve the matter. <br />
