CONDITIONS OF APPROVAL MS-99-26 Weidert Minor Subdivision Application No. MS-99-26 was approved by the San Joaquin County Community Development Department on January 20, 2000. The effective date of approval is January 30, 2000. This tentative map approval will expire on January 29, 2003, which is three years from the effective date of approval,unless(1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified,and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Tina Wehrmeister,468-8477) a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved Tentative Map dated December 9, 1999. b. LOT SIZE AND WIDTH: Parcel size and width shall conform to the approved Tentative Map dated December 9, 1999. c. NOTICE: A notice of Restriction of Minor Subdivision shall be recorded concurrently with the Parcel Map on both parcels which states that animals shall not be kept or maintained within the existing barns or similar structures closer than 40 feet from any rear or side property line. (Development Title Section 9-1045) 2. DEPARTMENT OF PUBLIC WORKS (Seethe attached memo dated January 5, 2000.) 3. PUBLIC HEALTH SERVICES (See the attached memo dated January 10, 2000.) 4. SOUTH SAN JOAQUIN IRRIGATION DISTRICT (See the attached letter dated January 6, 2000.) 5. DEPARTMENT OF PARKS AND RECREATION (Staff Contact: Jeff Smith, 953-8800) a. PARK FEES: Due to the relatively small size of the subdivision,less than fifty (50) parcels,the San Joaquin County Departmentof Parks and Recreation will require the collection of in-lieu fees for park development as a requirement for approval of the Map. (Development Title Section 9-1230.8) 6. COUNTY COUNSEL (Staff Contact: Dee Anne Watkins,468-2980) a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code.
