Please see Attachment <br /> A-CERS Submittal. <br /> Aboveground Petroleum Storage Act Inspection Report <br /> Item # 105 Violation code: CFR 112.1(b)(3), 112.2 Failed to properly close tanks under the <br /> definition of"Permanently Closed". <br /> OBSERVATION:A Convault tank located next to the 12,000-gallon diesel tank is not in use but <br /> has not been properly closed. A sign saying "Permanently Closed"with the date was not affixed <br /> to the tank. <br /> A used oil tank located in the transfer station is not in use but has not been properly closed. A <br /> sign with the words "Permanently Closed"is not affixed to the tank <br /> Response: Both the Convault Tank and Used Oil Tank had"Permanently Closed" labels <br /> previously attached to the tanks prior to inspection. On September 09, 2021 CVWS painted the <br /> words "Permanently Closed"and the date of closure on the Convault Tank and placed a new <br /> Label with the words "Permanently Closed" and the date of closure on the Used Oil Tank located <br /> in the Transfer Station. Please see pictures Attachment B <br /> Item 4706 Violation code: CFR 112.7(e), 112.8(c)(6) Failed to perform scheduled tank tests <br /> or inspections by appropriately qualified <br /> personnel. <br /> OBSERVATION: The facility failed to provide and maintain secondary containment for bulk <br /> storage tank installations sufficient to hold the capacity of the largest container, including <br /> adequate freeboard for precipitation. The 12,000-gallon diesel tank was observed with <br /> insufficient secondary containment. At the south end of the diesel tank a hole with a broken off <br /> pipe was observed in the floor of the secondary containment berm. <br /> Response: CVWS disagrees with this alleged violation and the observation does not allege the <br /> tank was not appropriately inspected. CVWS respectfully requests the alleged violation be <br /> rescinded. The diesel tank had sufficient secondary containment during the inspection dated <br /> August 17, 2021. The small "hole"was an old indentation with a depth of twelve inches that lead <br /> nowhere and could not have discharged nor did it affect the secondary containment. <br /> Nevertheless,on September 09, 2021 CVWS filled the "hole"with cement.
