, <br /> ATTACHMENT TO APPEAL FORM <br /> Applicant: Sam Loduca <br /> File No. : SU-88-1 <br /> Hearing Date: PC: 10-15-87 <br /> Basis of Appeal <br /> The Planning Commission denied the application to realign 10 <br /> parcels, consisting of 44. 57, acres into parcels ( Record Junction <br /> Tract) by failing to make the following findings: <br /> 1 . The proposed map is consistent with applicable general <br /> and specific plans. <br /> 2. The design or improvement of the proposed subdivision is <br /> consistent with applicable general and specific plans. <br /> 3 . The site is physically suitable for this type of <br /> development. <br /> 4. The site is physically suitable for the proposed density <br /> of the development. <br /> 5 . The design of the subdivision or the type of <br /> improvements will not conflict with easements, acquired by the <br /> public at large, for access through or use of property within the <br /> proposed subdivision. <br /> Applicant submits that sufficient evidence was presented and <br /> heard by the Planning Commission to make these findings and, <br /> therefore, the denial of the application was arbitrary and <br /> capricious. <br /> The applicant is the owner of Record Junction Tract, an <br /> antiquated subdivision that was recorded on June 17, 1911. The <br /> applicant originally submitted 8 Right-of-way applications and 8 <br /> Certificates of Compliance applications for 8 parcels of the <br /> Record Junction Tract. Applicant was advised by County staff, <br /> that since no new parcels were being created, applicant could <br /> file a minor subdivision application and realign the existing <br /> parcels to correct certain circulation problems about which <br /> County staff were concerned. On April 3, 1987, the Planning <br /> Division accepted a minor subdivision application to realign the <br /> existing parcels, requiring only a parcel map since no new <br /> parcels were being created. <br /> -2- <br />
