S A N J 0 A Q I I I Irl Environmental Health Department <br /> CCUN r <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> Love's Travel Stop#538 1 15250 N THORNTON RD, Lodi April 12, 2022 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 106 CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br /> OBSERVATION: The business operator could not produce documentation during the inspection that demonstrates <br /> employees have complete hazardous waste training as specified in this section. <br /> -An incomplete hazardous waste training record is on site. Missing description of duties of each title,job title, <br /> summary of training, and trainer is trained with proof. <br /> -Annual refresher is required. <br /> Per Jesse Diaz, the training record does not include duties of each job titles and summary of training. <br /> REGULATION GUIDANCE: Title 22 California Code of Regulations section 66265.16 Personnel Training <br /> CORRECTIVE ACTION: Immediately train all employees who work with hazardous waste in compliance with the <br /> time frames and training materials required by this section. Provide training documentation to the San Joaquin <br /> County Environmental Health Department(EHD)within 30 days. The documentation must include a list of training <br /> topics, date of training,job title, name of employee,written job description (qualifications and duties), and employee <br /> signed (or certified)record that documents the training. <br /> This is a Class II violation. <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: Designated facility signed and dated copies of Uniform Hazardous Waste Manifests (UHWM) <br /> were not found on-site. The missing manifests are: <br /> 030047704WAS shipped 3/11/2022 <br /> -030042399WAS shipped 9/15/2021 <br /> -030042336WAS shipped 8/13/2021 <br /> -030015666WAS shipped 12/6/2019 <br /> -030005418WAS shipped 9/18/2019 <br /> -030005402WAS shipped 9/12/20219 <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. The hazardous waste generator must submit an exception report to <br /> the California Department of Toxic Substances Control (DTSC)within 45 days if the destination facility signed <br /> manifest copy is not received from the transporter or designated facility. <br /> CORRECTIVE ACTION: Locate the destination facility signed manifests listed above and maintain in the facility file <br /> for three years from the date of shipping.
