If a <br /> container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it <br /> begins to leak,the owner or operator shall transfer the hazardous waste from this container to a container that is in <br /> good condition, or manage the waste in some other way that complies with the hazardous waste requirements. <br /> CORRECTIVE ACTION: Immediately transfer all hazardous wastes into containers that are in good condition. <br /> Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 406 CCR 66261.7 Empty hazardous waste or material container greater than 5 gallons not managed per this section. <br /> OBSERVATION: <br /> -Four metal black 55 gallon drums was observed inside the shipping container on the south side of the <br /> maintenance shop without label "empty"and date they were emptied. <br /> -One metal red 55 gallon drum was observed inside the shipping container on the south side of the maintenance <br /> shop without label "empty"and date they were emptied. <br /> Per technician inside the maintenance shop, "Those drums are empty.We are waiting for what they want to do with <br /> the drums. Probably scrap metal." <br /> REGULATION GUIDANCE: Empty containers which previously held a hazardous material, including hazardous <br /> waste must be managed per Title 22 California Code of Regulations(CCR)section 66261.7. Refer to this section <br /> and California Department of Toxic Substances Control guidance for more information. <br /> CORRECTIVE ACTION: Immediately label all empty containers with the date they were emptied and manage <br /> within one year of that date. Manage the container per Title 22 CCR section 66261.7.
