Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />April 19, 2022 <br /> Facility Address: <br /> 137 TENTH St, TRACY <br /> Facility Name: <br /> FAGUNDES 10TH STREET GARAGE <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. <br />- The 2022 business plan submittal has not been made <br />- The 2021 business plan submittal has not been made <br />- The 2020 business plan submittal has not been made <br />REGULATION GUIDANCE: The hazardous materials business plan (facility information, hazardous materials <br />inventory, emergency response and training plans) shall be submitted by January 15 of each calendar year and may <br />be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 1 violation(s) during the <br />inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br />statement documenting the corrective actions that have been or will be taken for each violation, and any <br />supporting paperwork, by 5/19/2022 <br />Documents provided during inspection: list of free CUPA classes, return to compliance certification and <br />corrective action statement <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($152).
