CONDITIONS OF APPROVAL SA-98-9 Holdener Site Approval Application No. SA-98-9 was approved by the San Joaquin County Community Development Department on April 1, 1998. The effective date of approval is April 11, 1998. This approval will expire on October 11, 1999, which is 18 months from the effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been secured and remain in force, and (3) all necessary permits from other agencies have been secured and remain in force. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Kai Luoma, 468-9567) a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT." The Site Plan required as a part of the building permit must be prepared by a registered civil engineer or licensed architect. This Plan must show drainage, driveway access details (including gates), on-site parking, landscaping, signs, existing and proposed utility services, and grading (refer to the"SITE PLAN CHECK LIST' for details). A fee is required for the Site Plan review. (Development Title Section 9-884) b. APPROVED USE: This approval is for a 140-foot-high lattice telecommunications tower and two 240 square foot equipment containers (use type: communication services, type ll), as shown on the plan submitted February 24, 1998. C. SIDE YARD SETBACK: The proposed buildings and tower shall be set back a minimum of 10 feet from the side lot line. (Development Title Section 9-610.5) d. MAINTENANCE OF FACILITIES: All freestanding structures, antennas, and supporting equipment associated with wireless telecommunication shall be maintained in good condition by the provider of the telecommunication facility and, whenever necessary, repaired or replaced. (Development Title Section 9-1065.7) e. REMOVAL OF FACILITIES: Freestanding structures, antennas, and supporting equipment associated with wireless telecommunication shall be removed by the provider of such facilities and the site restored to its preconstruction state if said facilities have not been operational or used for a period of six consecutive months. Removal and site restoration shall be completed within 90 days of the end of said six-month period. To guarantee removal of unused or abandoned facilities, the Review Authority may require the applicant to post a bond or other suitable security instrument. (Development Title Section 9-1065.8) f. PHASING: This project is approved for two phases. Phase II shall be completed within three years from the date of approval. 2.
