CONDITIONS OF APPROVAL <br /> SA-98-9 <br /> Holdener <br /> Site Approval Application No. SA-98-9 was approved by the San Joaquin County Community <br /> Development Department on April 1, 1998. The effective date of approval is April 11, 1998. This <br /> approval will expire on October 11, 1999, which is 18 months from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits <br /> have been secured and remain in force, and (3) all necessary permits from other agencies have <br /> been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to the establishment of the use and the issuance of any building permits. Those <br /> Conditions followed by a Section Number have been identified as Ordinance requirements <br /> pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance <br /> requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Kai Luoma, 468-9567) <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT." The <br /> Site Plan required as a part of the building permit must be prepared by a registered civil <br /> engineer or licensed architect. This Plan must show drainage, driveway access details <br /> (including gates), on-site parking, landscaping, signs, existing and proposed utility services, <br /> and grading (refer to the"SITE PLAN CHECK LIST' for details). A fee is required for the Site <br /> Plan review. (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is for a 140-foot-high lattice telecommunications tower and <br /> two 240 square foot equipment containers (use type: communication services, type ll), as <br /> shown on the plan submitted February 24, 1998. <br /> C. SIDE YARD SETBACK: The proposed buildings and tower shall be set back a minimum <br /> of 10 feet from the side lot line. (Development Title Section 9-610.5) <br /> d. MAINTENANCE OF FACILITIES: All freestanding structures, antennas, and supporting <br /> equipment associated with wireless telecommunication shall be maintained in good <br /> condition by the provider of the telecommunication facility and, whenever necessary, <br /> repaired or replaced. (Development Title Section 9-1065.7) <br /> e. REMOVAL OF FACILITIES: Freestanding structures, antennas, and supporting <br /> equipment associated with wireless telecommunication shall be removed by the provider <br /> of such facilities and the site restored to its preconstruction state if said facilities have <br /> not been operational or used for a period of six consecutive months. Removal and site <br /> restoration shall be completed within 90 days of the end of said six-month period. To <br /> guarantee removal of unused or abandoned facilities, the Review Authority may require <br /> the applicant to post a bond or other suitable security instrument. (Development Title <br /> Section 9-1065.8) <br /> f. PHASING: This project is approved for two phases. Phase II shall be completed within <br /> three years from the date of approval. <br /> 2.
