<br /> 11. Ten Year Product Warranty
<br /> Seller warrants that all individual product components of the
<br /> GeoFlex System sold by it shall be of good materials and
<br /> workmanship and free from functional defects for a period of ten
<br /> (10) years from the date of sale. Seller further warrants that all
<br /> products shall be compatible with gasoline, gasohol, ethanol,
<br /> methanol,kerosene,jet"A",aviation fuel,diesel fuel and motor
<br /> Oil.
<br /> This Limited Warranty shall be null and void if the products to
<br /> which it applies:(a)are employed in above ground applications,
<br /> (b) are installed by anyone other than an installer trained by
<br /> Seller, or in a manner which fails to comply to the Seller's
<br /> written installation instructions, (c) are installed in sites having
<br /> fuel contaminated backfill, and (d) have improperly anchored
<br /> underground storage tanks.
<br /> III. One Year Product Warranty
<br /> The Seller warrants that all other products, not described as
<br /> components of the GeoFlex System, sold by it shall be of good
<br /> materials and workmanship and free from functional defects for
<br /> a period of one (1)year from the date of sale.
<br /> This Limited Warranty shall be null and void if the products to
<br /> which it applies: (a) are installed by anyone other than an
<br /> installer trained by Seller, or in a manner which fails to comply
<br /> to the Seller's written installation instructions, or(b) respecting
<br /> Seller's coupling machine, if another manufacturer's couplings
<br /> have been employed.
<br /> AS THE EXCLUSIVE REMEDY FOR ANY BREACH OF THE ABOVE
<br /> LIMITED WARRANTIES, SELLER WILL REPLACE
<br /> NONCONFORMING GOODS OR REFUND THE PURCHASE PRICE.
<br /> THESE LIMITED WARRANTIES ARE IN LIEU OF ALL OTHER
<br /> WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT
<br /> LIMITED TO, THOSE CONCERNING MERCHANTABILITY OR
<br /> FITNESS FOR A PARTICULAR PURPOSE. THESE LIMITED
<br /> WARRANTIES ARE ALSO IN LIEU OF ANY OTHER POSSIBLE
<br /> LIABILITIES OF SELLER, WHETHER ALLEGED TO ARISE BY
<br /> AGREEMENT OR BY OPERATION OF LAW,RESPECTING THE SALE,
<br /> INSTALLATION, USE OR FUNCTION OF SELLER'S PRODUCTS. IN
