FINDINGS FOR USE PERMIT <br /> PA -2100164 & PA -2200028 <br /> JIANG ' S PROPERTIES MANAGEMENT , LLC / JKL SUNSHINE , INC . <br /> 1 . The proposed use is consistent with the goals , policies , standards , and maps of the General Plan , any <br /> applicable Master Plan , Specific Plan , and Special Purpose Plan , and any other applicable plan <br /> adopted by the County . <br /> • This finding can be made because the use type Commercial Cannabis — Cultivation and <br /> Distribution may be conditionally permitted in the AG40 ( General Agriculture , 40 -acre <br /> minimum ) zone with an approved Use Permit application and Commercial Cannabis <br /> Development Agreement . The project site has a General Plan designation of A / G ( General <br /> Agriculture ) , and the AG40 zone is an implementing zone for this designation . There are no <br /> Master Plans , Specific Plans , or Special Purpose Plans in the vicinity . <br /> 2 . Adequate utilities , roadway improvements , sanitation , water supply , drainage , and other necessary <br /> facilities have been provided , and the proposed improvements are properly related to existing and <br /> proposed roadways . <br /> • This finding can be made because adequate utilities , access roads , sanitation , drainage , <br /> and other necessary facilities have been provided and the proposed improvements are <br /> properly related to existing and proposed streets and highways . The project site is already <br /> served by a wastewater treatment system and storm drainage retention pond . A well will be <br /> constructed under permit and inspection by the Environmental Health Department . <br /> Additionally , all activities of the proposed project will be conducted indoors as required by <br /> Development Title Section 9 - 1090 . 3 ( c ) . <br /> The locational criteria for Commercial Cannabis — Cultivation projects that take place on a <br /> parcel located in the AG zone require that the parcel be located a maximum of 2 , 000 feet <br /> from a major intersection or arterial road . A project can be on a parcel that is located more <br /> than 2 , 000 feet from a major intersection or arterial road if the following criteria are found to <br /> be true : <br /> ■ There is sufficient ease of access from the proposed parcel to an arterial road ; <br /> ■ There is sufficient access for emergency vehicles ; and , <br /> ■ The applicant demonstrates that the parcel can be secured to the satisfaction of the <br /> County . <br /> The subject property is located on Navone Road and is located 4 , 165 feet from a major <br /> intersection . Navone Road connects to Fairchild Lane which connects with State Route 88 , <br /> a major intersection . Both Navone Road and Fairchild Lane are over 25 -feet wide , paved , <br /> and well - maintained . From that point on State Route 88 , it is approximately 2 miles to State <br /> Route 99 . This roadway network provides ease of access to and from the project site , <br /> including for emergency vehicles . The project location has been reviewed by the San <br /> Joaquin County Sheriff' s Office and the Waterloo - Morada Fire District and was found to <br /> have adequate access . Lastly , the applicant will work with the San Joaquin County Sheriff' s <br /> office to demonstrate that the parcel can be secured to the department ' s satisfaction . <br /> 3 . The site is physically suitable for the type of development and for the intensity of development . <br /> • This finding can be made because the 6 . 99 -acre parcel is of adequate size and shape to <br /> accommodate the proposed uses and the existing cold storage use which will remain , as <br /> well as yards , building coverage , setbacks , parking areas and other requirements of the <br /> Development Title . <br /> PA- 2100164 & PA- 2200028 — Findings 1 <br />
