BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br /> STATE OF CALIFORNIA <br /> RESOLUTION <br /> R- 23 - 75 <br /> Resolution to Approve Zoning Map Reclassification No . PA-2200087 and Site Approval <br /> No . PA -2200088 of Highway 12 Investors LLC and Kevin Huber <br /> ( District 4 ) <br /> WHEREAS , on March 2 , 2023 , the San Joaquin County Planning Commission <br /> considered Zoning Map Reclassification No . PA - 22000087 and Site Approval No . PA - 2200088 <br /> and voted 5 to 0 to forward them to the Board of Supervisors for approval ; and <br /> WHEREAS , on May 2 , 2023 , the Board of Supervisors conducted a properly noticed <br /> public hearing on Zoning Map Reclassification No . PA - 2200087 and Site Approval No . PA - <br /> 2200088 , as recommended by the Planning Commission , during which they received oral and <br /> documentary evidence on the matter ; <br /> NOW , THEREFORE , BE IT RESOLVED by this Board of Supervisors to : <br /> 1 . Adopt the Mitigated Negative Declaration (Attachment C to the Board letter dated <br /> May 2 , 2023 ) and Mitigation Monitoring and Reporting Program (Attachment D to <br /> the Board letter dated May 2 , 2023 ) for Zone Reclassification No . PA - 2200087 and <br /> Site Approval No . PA -2200088 ; <br /> 2 . Approve Zone Reclassification No . PA - 2200087 based on the ability to make the <br /> required Bases for Zoning Map Reclassification (Attachment A to the Board letter <br /> dated May 2 , 2023 ) ; <br /> 3 . Approve Site Approval No . PA - 2200088 with the attached Conditions of Approval <br /> (Attachment F to the Board letter dated May 2 , 2023 ) based on the ability to make the <br /> required Findings for Site Approval (Attachment B to the Board letter dated May 2 , <br /> 2023 ) . <br /> PASSED AND ADOPTED May 2 , 2023 , by the following vote of the Board <br /> of Supervisors , to wit . <br /> AYES : Villapudua , Canepa , Patti , Ding , Rickman <br /> NOES : None <br /> ABSENT : None <br /> ABSTAIN : None <br />
