<br /> 5 <br /> <br />SECTION 1.5 - RETENTION OF RECORDS <br /> <br />The General Permit (Sections I.J.69 and IV.G) requires that all dischargers maintain a paper or <br />electronic copy of all required records for three years from the date generated or date submitted, <br />whichever is last. These records must be available at the construction site until construction is <br />completed. The discharger shall furnish the RWQCB, SWRCB, or the US Environmental <br />Protection Agency (EPA), within a reasonable time, any requested information to determine <br />compliance with this General Permit. <br />SECTION 1.6 - REQUIRED NON-COMPLIANCE REPORTING <br /> <br />If a discharge occurs, the contractor shall file a written report to the Regional Water Quality Control <br />Board (RWQCB) through its online SMARTS website no later than 10 days after the conclusion of <br />the storm event. It is the responsibility of the permittee to properly document reportable discharges <br />or other violations of the General Permit. Exceedances and violations should be reporting using the <br />online SMARTS system and include the following: <br />The report to the Owner and to the RWQCB will contain the following items: <br />1) NAL Exceedance Report <br />o The analytical method(s) method reporting unit(s), and method detection limit(s) of <br />each analytical parameter (analytical results that are less than the method detection <br />limit shall be reported as “less than the method detection limit.” <br />o The date, place, time of sampling, visual observation (inspections), and/or <br />measurements, including precipitation <br />o A description of the current BMPs including planned BMPs not implemented <br />associated with the effluent sample that exceeded the NAL <br />o The date of deployment and type of control measures (BMPs) deployed after the <br />discharge event, or after receiving the notice or order, including additional measures <br />installed or planned to reduce or prevent re-occurrence; and <br />o An implementation and maintenance schedule for any affected BMPs <br />o Self-reporting of any other discharge violations or to comply with RWQCB <br />enforcement actions; and <br />2) Discharges which contain a hazardous substance in excess of reportable quantities <br />established in 40 CFR §§ 117.3 and 302.4, unless a separate NPDES permit has been issued <br />to regulate those discharges. <br /> <br />The records of all reportable NAL exceedances and other non-compliance events shall be kept and <br />logged in Appendix D until the completion of construction. <br />SECTION 1.7 - ANNUAL REPORTING <br /> <br />The General Permit requires that all permittees prepare, certify, and electronically submit an Annual <br />Report through SMARTS no later than September 1 of each year. The contractor shall prepare the <br />annual report as required for the project and submit the document as a Data Submitter (DS) on
