Order <br />2009-0009-DWQ amended by 2010-0014-DWQ & 2012-0006-DWQ <br /> 2 <br />Underground/Overhead Projects resulting in the disturbance of greater <br />than or equal to one acre (Attachment A). <br /> <br />3. This General Permit regulates discharges of pollutants in storm water <br />associated with construction activity (storm water discharges) to waters <br />of the United States from construction sites that disturb one or more <br />acres of land surface, or that are part of a common plan of <br />development or sale that disturbs more than one acre of land surface. <br /> <br />4. This General Permit does not preempt or supersede the authority of <br />local storm water management agencies to prohibit, restrict, or control <br />storm water discharges to municipal separate storm sewer systems or <br />other watercourses within their jurisdictions. <br /> <br />5. This action to adopt a general NPDES permit is exempt from the <br />provisions of Chapter 3 of the California Environmental Quality Act <br />(CEQA) (Public Resources Code Section 21100, et seq.), pursuant to <br />Section 13389 of the California Water Code. <br /> <br />6. Pursuant to 40 C.F.R. § 131.12 and State Water Board Resolution No. <br />68-16,1 which incorporates the requirements of § 131.12 where <br />applicable, the State Water Board finds that discharges in compliance <br />with this General Permit will not result in the lowering of water quality <br />standards, and are therefore consistent with those provisions. <br />Compliance with this General Permit will result in improvements in <br />water quality. <br /> <br />7. This General Permit serves as an NPDES permit in compliance with <br />CWA § 402 and will take effect on July 1, 2010 by the State Water <br />Board provided the Regional Administrator of the U.S. EPA has no <br />objection. If the U.S. EPA Regional Administrator objects to its <br />issuance, the General Permit will not become effective until such <br />objection is withdrawn. <br /> <br />8. Following adoption and upon the effective date of this General Permit, <br />the Regional Water Quality Control Boards (Regional Water Boards) <br />shall enforce the provisions herein. <br /> <br />9. Regional Water Boards establish water quality standards in Basin <br />Plans. The State Water Board establishes water quality standards in <br />various statewide plans, including the California Ocean Plan. U.S. <br />EPA establishes water quality standards in the National Toxic Rule <br />(NTR) and the California Toxic Rule (CTR). <br /> <br />1 Resolution No. 68-16 generally requires that existing water quality be maintained unless degradation is <br />justified based on specific findings. <br />
