Order <br />2009-0009-DWQ amended by 2010-0014-DWQ & 2012-0006-DWQ <br /> 31 <br /> <br />VI. RECEIVING WATER LIMITATIONS <br /> <br />A. The discharger shall ensure that storm water discharges and authorized <br />non-storm water discharges to any surface or ground water will not <br />adversely affect human health or the environment. <br /> <br />B. The discharger shall ensure that storm water discharges and authorized <br />non-storm water discharges will not contain pollutants in quantities that <br />threaten to cause pollution or a public nuisance. <br /> <br />C. The discharger shall ensure that storm water discharges and authorized <br />non-storm water discharges will not contain pollutants that cause or <br />contribute to an exceedance of any applicable water quality objectives or <br />water quality standards (collectively, WQS) contained in a Statewide <br />Water Quality Control Plan, the California Toxics Rule, the National Toxics <br />Rule, or the applicable Regional Water Board’s Water Quality Control Plan <br />(Basin Plan). <br /> <br />D. Dischargers located within the watershed of a CWA § 303(d) impaired <br />water body, for which a TMDL has been approved by the U.S. EPA, shall <br />comply with the approved TMDL if it identifies “construction activity” or <br />land disturbance as a source of the pollution.
