<br />Former Pilkington North America Site 1 Health and Safety Plan <br /> EKI B90047.00 <br />1. INTRODUCTION <br />This Site Health and Safety Plan (“HSP”), developed in accordance with Federal and California <br />Occupational Safety and Health Administration (“OSHA”) standards for hazardous waste <br />operations (29 CFR 1910.120 and 8 CCR 5192), establishes site‐specific health and safety <br />protocols for EKI Environment & Water, Inc. (“EKI”) personnel performing soil and groundwater <br />sampling at Former Pilkington North America Site in Lathrop, California (the “Site;” see Figure 1‐ <br />1). <br /> <br />The following additional reference sources and guidance documents published by the National <br />Institute for Occupational Safety and Health (“NIOSH”) and the American Conference of <br />Governmental Industrial Hygienists (“ACGIH”) were used to develop this HSP: <br /> <br /> ACGIH, 2018. Guide to Occupational Exposure Values. <br /> <br /> NIOSH, 2007. Pocket Guide to Chemical Hazards. September 2007. <br /> <br />For informational purposes only, this HSP may be provided to any sub‐contractors of EKI or <br />contractors of ASP/RWM Properties, LLC, R & B Louise, LLC and R & B Delta, LLC (the “Client”) <br />involved in activities at the Site. Entities and personnel other than EKI staff shall be solely <br />responsible for their own health and safety and shall independently assess on‐Site conditions and <br />develop their own health and safety protocol. However, other entities or personnel that <br />anticipate using health and safety measures which are less stringent than EKI’s measures should <br />immediately contact EKI’s Site Safety Officer (“SSO”). <br /> <br />EKI has developed a Corporate Health and Safety Plan (“CHSP”) for EKI employees. The CHSP <br />complies with current health and safety regulations, including OSHA 29 CFR 1910.120 and 8 CCR <br />5192, Hazardous Waste Operations and Emergency Response. Many of t he p rotocols o f the CHSP <br />are conducted on a routine basis (general training, respirator fit testing, general medical record <br />keeping, etc.) and are not repeated herein. Questions regarding the EKI CHSP are referred to <br />Claudia Cuadrado, P.E., Corporate Safety Manager. <br /> <br />A copy of this HSP, along with any addenda containing activity‐specific health and safety <br />information, will be kept in a conspicuous location on Site at all times while work is being <br />conducted by EKI personnel. <br />1.1 Multi‐Employer Worksite Procedures <br />In light of the Cal‐OSHA Multi‐Employer Worksite Rule, EKI is explicitly stating that all site <br />employers are specifically responsible for the health and safety of their respective employees. <br />EKI has no contractual responsibility, control or authority over the health and safety of <br />contractors at the Site. EKI has no authority to correct Site hazards created by other site <br />personnel. EKI personnel will not assume such responsibility in the field.
