Although this should not be pertinent since the lateral and vertical limits of the WU1 area on Parcel A have been identified and removed. The property owners have removed the WU1 area that extended onto Parcel A, and then exceeded the scope of work by removing as much of the surficial glass as possible. Additionally, trenching performed in the excavation confirmed that WU1 has been removed and verification sample results indicated that COC concentrations are below the appropriate screening levels. The work agreed to during meetings with the EHD in December 2018 to attain clean closure for WU1 on the subject property have been performed. The WU1 area has been removed and the trenching and verification sample results support this conclusion. The property owners and AGE believe the EHD should fulfill the agreement and commitment communicated in December 2018 and clean closure of this area on the subject property should be approved. Additionally, following satisfactory analytical results, the stockpiled materials removed from WU1 on Parcel A should be approved for reuse on the property in accordance with the protocol established for Parcel B to the south (17100 Murphy Parkway, Lathrop). Without acknowledgement of the clean closure designation pursuant to the December 2018 agreement, the property owners will have no incentive to dispose of or reuse the stockpiled materials.
