Per work order 7150, Elite IV Contractors placed liquid in a <br /> hazardous waste drum on 1/16/2022. The drum on site was empty. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years 5/17/2019-5/17/2022 for any <br /> liquid hazardous waste generated by the facility. Provide these records and a corrective action statement to the <br /> EHD within 30 days. <br /> This is a repeat violation, Class II. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: Fuel hoses were placed on top of the hazardous waste drum to be disposed of. One of the hoses <br /> had fallen onto the ground. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by the hoses being placed inside the <br /> hazardous waste drum. No further action is required to correct this violation. <br /> This is a Class II violation. <br /> 304 CCR 66262.34(d)(2) Failed to maintain adequate aisle space for unobstructed response to emergencies. <br /> OBSERVATION: The following area does not have adequate aisle space: The hazardous waste drums are stored <br /> in an enclosure. The drums had trash blocking them and were not readily accessible. <br /> REGULATION GUIDANCE: The owner or operator shall maintain aisle space to allow the unobstructed movement <br /> of personnel,fire protection equipment, spill control equipment, and decontamination equipment to any area of <br /> facility operation in an emergency, unless it can be demonstrated to the Department that aisle space is not needed <br /> for any of these purposes. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by the trash being cleared.
