OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three years during the inspection for fuel contaminated liquid. Per work order 7150, Elite IV Contractors placed liquid in a hazardous waste drum on 1/16/2022. The drum on site was empty. REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. CORRECTIVE ACTION: Provide a copy of disposal records for the past three years 5/17/2019-5/17/2022 for any liquid hazardous waste generated by the facility. Provide these records and a corrective action statement to the EHD within 30 days. This is a repeat violation, Class II. 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. OBSERVATION: Fuel hoses were placed on top of the hazardous waste drum to be disposed of. One of the hoses had fallen onto the ground. REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, or surface water which could threaten human health or the environment. CORRECTIVE ACTION: The violation was corrected during the inspection by the hoses being placed inside the hazardous waste drum. No further action is required to correct this violation. This is a Class II violation. 304 CCR 66262.34(d)(2) Failed to maintain adequate aisle space for unobstructed response to emergencies. OBSERVATION: The following area does not have adequate aisle space: The hazardous waste drums are stored in an enclosure. The drums had trash blocking them and were not readily accessible. REGULATION GUIDANCE: The owner or operator shall maintain aisle space to allow the unobstructed movement of personnel,fire protection equipment, spill control equipment, and decontamination equipment to any area of facility operation in an emergency, unless it can be demonstrated to the Department that aisle space is not needed for any of these purposes. CORRECTIVE ACTION: The violation was corrected during the inspection by the trash being cleared. No further action is required to correct this violation. This is a Class II violation.
